Amending of Law Concerning Egyptian Nationality

Concerning Egyptian Nationality                         

 

         

 

In the Name of the People

The President of the Republic

The People's Assembly has passed the following law, and we issued it:

(Article 1)

Replace the text of article (2) of law of # 26 for year 1975 concerning the Egyptian Nationality with the

following text:

Article (2)

“The following shall be Egyptian:

  1. Anyone who is born of an Egyptian father, or an Egyptian mother
  2. Anyone who is born in Egypt from unknown parents. A foundling in Egypt shall be considered born in it unless otherwise established.”

The one to whom a foreign nationality is established besides the Egyptian nationality according to the provisions of the previous clause, may announce to the Ministry of Interior his wish to relinquish the Egyptian nationality. Announcing this wish, with regard to a minor, shall be through his legal representative, his mother, or the person in charge of raising him in case neither one exists.

A minor who forfeits his Egyptian nationality according to the provision of the previous clause may announce his wish to recover it within the year next to attaining his legal age.

The procedures and dates to be followed in implementing the provisions of the two previous clauses must be issued by means of a decree of the Minister of Interior. The loss of the Egyptian nationality by relinquishment or recovery according to these provisions must be determined by means of a decree of the Minister of Interior.

(Second Article)

The text of Article 3 of the law referred to 26 of year 1975 has been cancelled 

(Third Article) 

A person born to an Egyptian mother and non-Egyptian father before the effective date of the present law may announce to the minister of interior his wish to enjoy the Egyptian nationality. Such person shall be considered Egyptian by virtue of a decree to be issued by the minister, or with the lapse of one year from the date of such announcement without the issue of a substantiated refusal decree from the minister Enjoying the Egyptian nationality according to the provision of the previous clause shall result in enjoying it by the minor children. Enjoying this nationality by adults shall be through following the previous procedures.

If a person born to an Egyptian mother and non-Egyptian father dies before the effective date of the present law, his children must have the right to enjoy the Egyptian nationality according to the provisions of the two previous clauses.

In all cases, the wish to enjoy the Egyptian nationality with the regard to a minor child shall be announced by his legal representative, his mother, or the person in charge of raising him up case neither one exists. 

(Fourth Article) 

The present law must be published in the official newspaper and shall go into effect starting from the day following its publishing. The present law must be sealed with the State’s Stamp and must be enforced as one of its laws.
