Procedures for obtaining registration in the Register of Advertising and Marketing Agencies
Pursuant to the provisions of Law No. (120) of 1982 and its Executive Regulations issued
by Ministerial Decree No. (342) of 1982, and Ministerial Decree No. 962 of 2012
Administration of the Register of Advertising, Publicity, and Marketing Agencies:
This administration is responsible for issuing the Register of Advertising, Publicity, and Marketing Agencies, in accordance with the provisions of Law No. (120) of 1982 and its Executive Regulations issued by Ministerial Decision No. (342) of 1982, and Ministerial Decision No. 962 of 2012, as for any natural or juridical person engaged in the field of advertising and publicity, whose activities involve procuring and marketing advertising materials for the purpose of publication or broadcast through any printed, audio, visual, or digital medium, whether on a commission, contractual, piecework, or any other type of agencies.
Mandatory Requirements for Registration in the Register of Advertising, Publicity, and Marketing Agencies:
- Maintaining a dedicated register for each advertising, publicity, or marketing agency, in which all relevant contracts and any subsequent amendments are registered.
- The obligation on the advertising, publicity, and marketing agency to submit to the authority any amendments to the contract or its parties, in accordance with the applicable provisions.
- Obligating to the advertising, publicity, and marketing agent to submit to the competent authority any advertising and publicity contracts assigned to them during the registration period.
First: Required Documents for Registering Sole Proprietorships in the Register of Advertising, Publicity, and Marketing Agencies:
Completion of the registration application signed by the applicant in front of the competent employee or signature authenticated by an accredited bank.
The original contract for the advertising, publicity, or marketing agency.
A valid official extract of the commercial register indicates that advertising, publicity, or marketing activities are included in the scope.
Copy of the tax card complete and consistent with the information provided in the commercial registry (Original for verification).
Copy of the personal identification document (original for verification).
An official extract from the birth certificate or military service records to prove nationality or a citizenship certificate if the applicant is of a foreign origin and it must be held for more than ten years.
Decision accepting resignation or termination of service for former employees of the government, public sector, business sector, public institutions, or local government units, provided that at least two years have elapsed since leaving the job.
Signing of the declaration form specific to the Register of Advertising, Publicity, and Marketing Agencies by the applicant in front of the competent employee or signature authenticated by an accredited bank.
Notes:
Registrations are issued for a five-year period, regardless of the duration of the advertising, publicity, or marketing agency agreement.
Registration is renewed every five years, and the renewal application must be submitted within the ninety days prior to the end of the registration period to avoid double fees within the ninety days following the end of the registration period, after this period, the registration will be administratively canceled.
Second: Required Documents for Registering Companies in the Registry of Advertising, Publicity, and Marketing Agencies:
Completion of the Registration Application singed by (the concerned party, the responsible manager, the Chairman of the Board, or the Managing Director) in front of the competent employee or signature authenticated by an accredited bank.
Original Advertising, Publicity, or Marketing Agency Contract.
A valid official extract of the commercial register indicates that advertising, publicity, or marketing activities are included in the scope, including the company's head quarter, and the company's capital should not be less than 20,000 EGP.
Certified copy of the company's Memorandum of Association and any amendments, for joint-stock companies, limited partnerships by shares, and limited liability companies, a copy of the company's articles of association must be provided and must match the commercial registry.
A copy of the tax card with complete and matching details with the commercial registry (original for review). Public sector companies are exempted from this.
Latest Financial Statement: Submitted to the tax authority for the previous fiscal year to prove that the company's capital is no less than EGP 20,000 if the company has been in operation for more than one year. If the company has been in operation for less than one year, a certificate indicating the deposit of this amount in a accredited bank in the company's name must be provided. Public sector companies are exempted.
The following documents must be submitted by all general partners, managers, chairman and members of the board of directors who have the authority to manage and sign, and whose names are listed in the commercial registry (public sector companies are exempt):
A criminal record certificate in accordance with Decision No. 362 of 2005.
Proof of identity document (the original for verification).
An official extract from the birth certificate or a citizenship certificate if the applicant is of foreign origin and it must be held for more than ten years, this clause applies to limited partners in limited partnerships, and limited liability companies are treated as partnerships companies.
A decision accepting the resignation or a decision terminating the service for former employees of the government, public sector, public business sector, public institutions or authorities, or local government units, and two years must have passed since leaving the job.
Signing the Declaration Form for the Registry of Advertising, Publicity, and Marketing Agencies by the person authorized to manage and sign in front of the competent employee or bank signature authentication.
